These terms govern your use of the Curowell website and services. By accessing or using curowell.com, you agree to be bound by these terms. If you do not agree, please do not use our website or services.

1. What Curowell provides

Curowell is a patient management platform for healthcare practices. Our website provides information about our product, a blog with industry insights, and ways to get in touch with our team. Our platform (available to registered users) provides appointment scheduling, patient communication, automated reminders, and practice analytics tools.

2. Eligibility

You must be at least 18 years old to use our services. If you are creating an account on behalf of a healthcare practice or organisation, you confirm that you have the authority to accept these terms on their behalf.

3. Your account

If you create a Curowell account, you are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at security@curowell.com.

We reserve the right to suspend or terminate accounts that violate these terms, are used for fraudulent purposes, or pose a security risk to our platform or other users.

4. Acceptable use

When using Curowell, you agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to our systems, other user accounts, or any data you are not authorised to access
  • Interfere with or disrupt the service, servers, or networks connected to the service
  • Upload or transmit malicious code, viruses, or any material designed to damage or interfere with the service
  • Scrape, crawl, or use automated tools to extract data from the service without our written permission
  • Resell, sublicence, or redistribute access to the service without authorisation

5. Healthcare disclaimer

Curowell is a practice management and patient communication tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations. Healthcare providers using Curowell remain solely responsible for all clinical decisions and patient care. Nothing on our website or within our platform should be interpreted as medical advice.

6. Intellectual property

All content on the Curowell website — including text, graphics, logos, icons, images, blog posts, and software — is the property of Curowell or its content creators and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent. You may share links to our blog posts and pages, and you may quote short excerpts with proper attribution.

7. Subscriptions and payments

Certain features of Curowell require a paid subscription. When you subscribe:

  • Pricing is as displayed on our website at the time of purchase. We will notify you in advance of any price changes
  • Subscriptions renew automatically unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period
  • Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, contact us at billing@curowell.com

8. Data and privacy

Your use of Curowell is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. For healthcare providers, we enter into Business Associate Agreements (BAAs) as required to ensure compliance with applicable healthcare data protection regulations.

9. Service availability

We work hard to keep Curowell available and reliable, but we cannot guarantee 100% uptime. We may occasionally need to take the service offline for maintenance, updates, or unforeseen technical issues. We will provide reasonable notice of planned downtime when possible.

10. Limitation of liability

To the fullest extent permitted by law, Curowell and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the service.

Our total liability for any claim related to the service shall not exceed the amount you paid to Curowell in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Curowell, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

12. Modifications to these terms

We may update these terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, notify you by email or through the service. Your continued use of Curowell after changes take effect constitutes acceptance of the revised terms.

13. Governing law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the service shall be resolved in the courts of competent jurisdiction.
